These Terms of Service (“Terms”) set out the rules for using the LenderIQ platform (“Platform”, “Service”), run by LenderIQ (“we”, “us”, or “our”). By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
LenderIQ is an AI-powered tool that helps people in Australia find non-bank and private lenders for business and commercial lending needs. You tell us what you need, and our system matches your scenario against a curated database of specialist lenders using a mix of structured filtering and artificial intelligence.
LenderIQ is not a lender, credit provider, or financial adviser. We do not provide financial product advice or credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth) (“NCCP Act”) or the Corporations Act 2001 (Cth).
We only deal with non-NCCP loans. This means we help with business-purpose and commercial loans only — for example, commercial property finance, business equipment loans, working capital, and development finance. We cannot help with loans that are regulated under the NCCP Act, such as home loans for personal use, personal loans, or consumer car finance. If your loan falls under the NCCP Act, you will need to speak with a licensed mortgage broker or financial adviser.
If you would like extra help, you can ask us to act as an adviser to facilitate communication between you and non-bank or private lenders. This is an optional service — you do not have to use it. When we provide advisory services, we help you navigate the process, explain lender requirements in plain language, and liaise with lenders on your behalf.
Even when we provide advisory services, we are not providing financial product advice or credit assistance regulated under the NCCP Act. Our advisory role is limited to facilitating introductions and communications for non-NCCP business and commercial loans only. The final decision on any loan is always between you and the lender.
All lender matches, suggestions, and information shown by LenderIQ are AI-generated suggestions only. They are created by automated systems and are meant as a starting point — not a final answer.

Everything on the Platform — the content, data, software, algorithms, and design — belongs to or is licensed by LenderIQ and is protected by Australian and international intellectual property laws. You can use the lender match results for your own purposes, but you cannot copy, sell, or commercially use our underlying data, algorithms, or lender database.
The Platform is provided “as is” and “as available.” We do not promise that:
To the fullest extent allowed by law, LenderIQ, its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages — including lost profits, lost data, or missed opportunities — arising from your use of (or inability to use) the Platform or our advisory services.
To the fullest extent allowed by law, our total liability to you for any claim related to the Platform will not exceed the total fees you have paid to LenderIQ in the 12 months before the event that caused the claim, or AUD $100, whichever is more.
Nothing in these Terms takes away any rights you have under Australian Consumer Law that cannot be excluded.
You agree to cover LenderIQ and its directors, officers, employees, and agents against any claims, costs, or damages arising from: (a) your use of the Platform or advisory services; (b) your breach of these Terms; (c) any decisions you make based on information from the Platform; or (d) your breach of any applicable law.
We may change, pause, or stop the Platform (or any part of it) at any time. We may also update these Terms. If we make important changes, we will let you know through the Platform or by other reasonable means. If you keep using the Platform after changes take effect, that means you accept the updated Terms.
We may suspend or end your access to the Platform at any time if we believe you have broken these Terms. When your access ends, you must stop using the Platform immediately. Sections 4, 7, 9, 10, and 13 continue to apply after termination.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled by the courts of New South Wales, Australia.
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms still apply in full.
